1. ACCEPTANCE OF TERMS

By accessing and using Studio Awaken's website (studioawaken.com) and services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. DESCRIPTION OF SERVICE

Studio Awaken provides online meditation and wellness services including:

• On-demand guided meditation sessions

• Mindfulness practices and courses

• Live interactive meditation sessions (purchased separately)

• Monthly subscription-based access to meditation content

• Educational resources and digital wellness content

3. USER ACCOUNTS Account Creation:

• You must provide accurate and complete information

• You are responsible for maintaining account security

• One account per person

• You must be at least 18 years old to create an account

Account Responsibilities:

• Keep login credentials confidential

• Notify us immediately of unauthorized access

• You are liable for all activities under your account

• Provide updated information when necessary

4. SUBSCRIPTION TERMS AND LIVE SESSIONS

Awaken Essential Subscription:

• Monthly billing in advance at $3.99/month

• Includes access to on-demand meditation content library only

• Live sessions are NOT included in Awaken Essential subscription

• Monthly subscriptions renew automatically on the same date each month

• All subscription fees are non-refundable except as stated in our refund policy

Live Sessions:

• Live interactive meditation sessions are purchased individually

• Live session fees are separate from subscription costs

• Live sessions must be booked and paid for in advance

• Live session fees are non-refundable once booked

• We may introduce additional subscription tiers in the future that include live sessions Future Subscription Plans:

• We reserve the right to introduce new subscription tiers

• Each subscription tier will have clearly defined included services

• Existing subscribers will be notified of new options

Cancellation:

• You may cancel your subscription at any time through your account settings

• Cancellation takes effect at the end of your current billing period

• No refunds for partial months or unused portions

• Access continues until the end of your paid period Price Changes:

• We reserve the right to change subscription prices

• You will be notified 30 days before any price increases

• Continued use after notification constitutes acceptance

5. ACCEPTABLE USE

You agree NOT to: • Share your account credentials with others

• Download, copy, or redistribute our on-demand content

• Use our services for illegal purposes

• Harass other users or staff

• Attempt to hack or disrupt our services

• Create multiple accounts to abuse free trials

• Use automated systems to access our content

You agree TO:

• Use services for personal, non-commercial purposes only

• Respect intellectual property rights

• Follow community guidelines

• Report any technical issues or violations

6. INTELLECTUAL PROPERTY

Our Content:

• All meditation content, audio, video, and text is our property

• Protected by copyright, trademark, and other laws

• You receive a limited, non-transferable license to stream content

• License terminates when your subscription ends

• Content is for streaming only - no downloading permitted

User Content:

• You retain rights to content you submit (reviews, comments)

• You grant us license to use, display, and distribute your content

• You represent that you have rights to submit content

• We may remove user content at our discretion

7. HEALTH AND MEDICAL DISCLAIMER IMPORTANT HEALTH INFORMATION:

Medical Consultation Required:

• Consult your physician before beginning any meditation, mindfulness, or wellness program

• If you have any medical conditions, injuries, or health concerns, obtain medical clearance before participating

• Pregnant women should consult their healthcare provider before participating

• If you experience any pain, discomfort, or unusual symptoms during or after sessions, stop immediately and consult a healthcare professional

Not Medical Treatment:

• Our meditation and wellness services are for general wellness and relaxation purposes only

• Services are not intended as medical treatment, therapy, or medical advice

• We make no medical claims about our services

• Our instructors are not medical professionals unless specifically stated Assumption of Risk:

• You participate in all services at your own risk

• You assume full responsibility for any injuries or health issues that may result from participation

• This includes both physical and mental health effects

8. LIMITATION OF LIABILITY AND INJURY WAIVER COMPLETE WAIVER OF LIABILITY:

Personal Responsibility:

• You acknowledge that meditation and wellness practices involve inherent risks

• You voluntarily assume all risks associated with participation

• You are solely responsible for your physical and mental well-being during sessions Release from Liability:

• You release Studio Awaken, its owners, instructors, employees, and affiliates from any and all liability for injuries, damages, or losses

• This includes but is not limited to: physical injuries, emotional distress, property damage, or any other harm

• This waiver applies to all services including live sessions, on-demand content, and any other offerings

No Liability for Injuries:

• Studio Awaken is not responsible for any injuries, accidents, or health issues that occur during or after participation

• This includes injuries occurring in your home or other location while following our content • You agree not to hold us liable for any medical expenses, lost wages, or other damages Maximum Liability:

• To the maximum extent permitted by law, our total liability is limited to the amount you paid in the last 12 months

• We provide services "as is" without warranties of any kind

• We are not liable for indirect, incidental, or consequential damages

• We do not guarantee uninterrupted service availability

9. INDEMNIFICATION

You agree to indemnify and hold us harmless from claims arising from:

• Your use of our services

• Your violation of these terms

• Your violation of third-party rights

• Your user-generated content

• Any injuries or damages you may suffer or cause

10. PRIVACY

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your information.

11. REFUND POLICY

Monthly Subscription Refunds:

• First-time subscribers: 5-day money-back guarantee

• Refund requests must be submitted within 5 days of first payment • No refunds after the 5-day period

• Refunds processed within 5-10 business days

Live Session Refunds:

• Live sessions are non-refundable once booked

• Cancellations must be made at least 24 hours in advance for rescheduling

• No refunds for missed sessions or technical issues on user's end

Refund Process:

• Include account email and reason for refund

• We may ask for feedback to improve our services

12. TERMINATION

We may terminate your account for:

• Violation of these terms

• Fraudulent activity

• Non-payment of fees

• Abuse of our services

Upon termination:

• Your access to services ends immediately

• No refunds for remaining subscription time

• We may delete your account data

• These terms survive termination where applicable

13. MODIFICATIONS TO TERMS

We may update these Terms and Conditions by:

• Posting changes on our website

• Sending email notifications

• Updating the "Last Updated" date

• Continued use after changes constitutes acceptance of new terms

14. MODIFICATIONS TO SERVICE

We reserve the right to:

• Modify or discontinue services at any time

• Change features, content, or functionality

• Impose usage limits or restrictions

• Update our platform and technology

15. DISPUTE RESOLUTION

Governing Law:

These terms are governed by the laws of the United States. Dispute Process:

• First, contact us to resolve issues informally

• If unresolved, disputes will be settled through binding arbitration

• Arbitration conducted under American Arbitration Association rules

• You waive right to jury trial and class action participation

16. FORCE MAJEURE

We are not liable for delays or failures due to circumstances beyond our control, including:

• Natural disasters

• Government actions

• Internet service disruptions

• Technical failures by third parties

17. SEVERABILITY If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. ENTIRE AGREEMENT These Terms and Conditions, along with our Privacy Policy, constitute the entire agreement between you and Studio Awaken regarding our services.

20. SPECIAL PROVISIONS

Free Trial Terms:

• Free trials are limited to new users only

• One free trial per person/household

• Credit card required for trial signup

• Automatic monthly billing begins after trial period unless cancelled On-Demand Content: • All content is streamed online only

• No downloading or offline access permitted

• Content library may change without notice

• Internet connection required for access

 

Live Session Terms:

• Live sessions require advance booking and payment

• Camera and microphone requirements determined by individual instructors

• Technical requirements are user's responsibility

• Rescheduling available with 24-hour notice

 

ACKNOWLEDGMENT OF RISK AND WAIVER

By using Studio Awaken's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You specifically acknowledge that you understand the risks involved in meditation and wellness practices and that you voluntarily assume these risks.

 

YOU ACKNOWLEDGE THAT THIS AGREEMENT INCLUDES A WAIVER OF LIABILITY AND ASSUMPTION OF RISK.
